IPBA Arbitration Day 2022: International Arbitration in the Endemic Age

The Covid-19 pandemic has changed the world in more ways than one could ever imagine. While the pandemic created unprecedented challenges, great opportunities for change and innovation also came along, even in the international arbitration landscape.

In this endemic age, it is apt for us to take a step back to reflect on the past two years to assess the significant trends and developments related to international commercial and investment arbitration across the Asia-Pacific region, to ascertain the changes, in particular the novel types of disputes and practices that have evolved, as well as to explore the future of international arbitration. Mediating a $1B International Dispute: Insights of Mediator and Counsel to Avoid Pitfalls and Achieve Success

It started with a pot of fragrant tea and mini mooncakes which had been hand-carried to Seoul by the mediator from Singapore. Using the example of the Singapore International Mediation Centre’s largest case to-date, this event features key players in the US$1-billion matter and explores the cross-cultural and cross-border aspects of mediation as practised in civil and common law jurisdictions. It will also examine the varying approaches taken in different jurisdictions (e.g. evaluative vs facilitative, transformative) which affect users‘ perceptions and acceptance of the process.

Lawyers play an important role throughout the mediation journey. They need to be familiar with the principles of mediation and negotiation strategies, manage expectations and sometimes deploy a different set of skills to support the client’s best interests. For corporate clients, it is important to have a mediation advocate who knows the ideal resolution strategy to adopt and at which stage of a dispute, and who can advise on creative solutions which serve business objectives, save time and costs. This 2.5-hour luncheon talk takes a behind-the-scenes look at how a complex energy dispute spanning five arbitrations across three jurisdictions – London, Seoul and Singapore – was successfully mediated in less than four days.

Launch of the Singapore International Dispute Resolution Academy’s International Dispute Resolution Survey 2022 Final Report

The Singapore International Dispute Resolution Academy (SIDRA) will be launching its International Dispute Resolution Survey 2022 Final Report on 31 August 2022. The SIDRA Survey is commissioned by the Singapore Ministry of Law and is into its second iteration, with the first SIDRA Survey Report launched on 3 July 2020.The 2022 Final Report continues to examine how users of dispute resolution mechanisms, including businesses and their legal representatives, make decisions about resolving cross-border disputes. At the launch, SIDRA will present a brief overview of the findings which will touch on international commercial arbitration, international commercial mediation, international commercial litigation, hybrid processes, and investor-state dispute settlement. This will be followed by a live panel discussion comprising the Survey Report authors, and various users such as private practice lawyers and in-house counsel.
