Silence in mediation can be disarming, strategic, respectful — or a sign of resistance. In international and cross-cultural mediations, it’s rarely just a pause in speech. It’s a message — sometimes subtle, sometimes loud. This panel brings together leading voices from across the world to explore how silence and cultural context shape mediation dynamics. From the boardroom to the breakout room, understanding what’s unsaid is becoming a defining skill for effective dispute resolution. This session will unpack how silence plays out in negotiation, how it’s shaped by cultural norms, and how mediators and counsel can bridge gaps that words alone can’t.

Speakers

Dr Vanina SUCHARITKUL
Partner, Rajah & Tann Singapore
Dr Vanina Sucharitkul is a Partner at Rajah & Tann Singapore specialising in international arbitration. Admitted in California, she advises on cross-border and investment disputes, acts as counsel in arbitrations under various institutional rules, and also sits as arbitrator. Her career spans San Francisco, Bangkok, Paris, Hong Kong and Singapore. Vanina served nine years on the court of a prominent arbitral institution, two terms on the ArbitralWomen board, and now chairs Ciarb Thailand while co-founding Young THAC. Educated at UC Berkeley, UC Hastings, Golden Gate, and Paris-Panthéon-Assas University, she is tri-national and fluent in Thai, French and English.

Dr. Wei SUN
Managing Partner, Zhong Lun Law Firm
Wei Sun is a managing partner at Zhong Lun Law Firm, Beijing, qualified to practice in the People’s Republic of China and the New York State of the United States of America.
Dr. Sun has extensive experiences in arbitration (both as counsel and arbitrator), litigation and civil enforcement relating to construction and infrastructure, energy, finance, corporate equity, and real estate. He also takes up important roles in the international arbitration community.
Drawing on his practical experience, Dr. Sun is a prolific writer and has published many books and articles in Chinese and English in his field of expertise.

Donna ROSS
International ADR Practitioner
Donna Ross is an international ADR practitioner qualified in both civil and common law and the principal of Donna Ross Dispute Resolution and an Adjunct Professor at the National University of Singapore Law Faculty. Donna has acted as arbitrator, mediator and advocate in complex cross-border deals and disputes in ITC, private equity, construction, shipping, M&A, JV and shareholder matters, import, licensing and distribution, and the wine industry.
She is a Fellow and faculty member of CIArb, a Fellow of ACICA, an IMI and SIMI Certified Mediator, an accredited mediator in New York and Australia and a Law Institute of Victoria Accredited Specialist in Mediation Law.

Hiroyuki TEZUKA
Partner, Nishimura & Asahi
Hiroyuki heads the international dispute resolution practice of Nishimura & Asahi, the largest law firm in Japan, and serves a member of the ICDR Asia Advisory Council, Vice President of the Japan Association of Arbitrators and Chief Director of the Japan International Mediation Center in Kyoto. He has handled a variety of international arbitration cases under the AAA-ICDR and various other rules, as well as international mediation cases, as counsel and as an arbitrator (including chair) or mediator. He served as Vice-Chair of the Arbitration Committee of the International Bar Association and as Co-Chair of the Dispute Resolution & Arbitration Committee of the Inter-Pacific Bar Association.

Michael PEER
Forensic Accountant
As a forensic accountant with over 30 years of experience, Michael assists with complex disputes across a multitude of sectors. Michael has a deep understanding of the technical and commercial aspects of dispute resolution. His expertise has been relied upon in numerous high-stakes cases. Throughout his career, he has developed a reputation for integrity, independence, and intellectual rigor, earning the respect of legal professionals and industry peers alike. Nandini KHAITAN
Partner, Dispute Resolution Practice, Khaitan & Co LLP
Nandini Khaitan is a partner with the Dispute Resolution Practice of Khaitan & Co LLP and is a dual qualified lawyer (New York and India). She represents clients before various Indian Courts and Tribunals, including the Supreme Court of India. Nandini has extensive experience in a broad range of complex commercial, environmental, family litigations and arbitrations both domestic and international. Nandini is an executive member of various coveted associations including The Arbitration Bar of India and AAA- ICDR. Her practice has led her to be recognised as The Economic Times 40 under 40 Business Leader of India.

Shanti ABRAHAM
Lawyer, Arbitrator, Mediator and Adjudicator
Shanti Abraham is a lawyer of over 30 years standing. She is called to both the Malaysian and Singapore Bars. Shanti is also an arbitrator, mediator and adjudicator. She has an active corporate and dispute resolution legal practice in Kuala Lumpur.
Her legal practice features a strong focus in alternate/appropriate dispute resolution and thought leadership - in particular Mediation and Arbitration. Her corporate and dispute resolution practice spans various diverse sectors including Construction, Commercial, Estate Planning and Wealth Management. She is also an International Mediator with various leading international institutions, including the AAA-ICDR.
She was also part of the Malaysian government appointed Pro-Tem Committee in 2025 and currently part of a Malaysian Ministerial Taskforce to look into setting up a government-led Mediation Centre.

Sae Youn KIM
Partner, International Arbitration & Cross-Border Litigation Practice, Kim & Chang
Sae Youn Kim is a partner of the International Arbitration & Cross-Border Litigation Practice of Kim & Chang. Ms. Kim practices primarily in the areas of international litigation and arbitration with an emphasis on commercial and international law.
Before joining Kim & Chang, she served as a judge at various Korean district courts, and practiced as a key member in major Korean law firms. Ms. Kim also sits as an arbitrator. Her expertise in international dispute resolution has been recognized by the variety of roles she holds and held in various institutions.

TAN Chuan Thye
Senior Counsel, Partner, Rajah & Tann Singapore
Chuan Thye is a Senior Counsel of the Supreme Court of Singapore and a Fellow of the Chartered Institute of Arbitrators. He has a broad commercial, corporate, and financial dispute resolution practice as lead counsel in various court and arbitration proceedings.
Chuan Thye has sat on a significant number of arbitration proceedings both as sole arbitrator and as part of a tribunal. He is on the panel of arbitrators of several leading institutions. He is currently chair of the Singapore branch of the Chartered Institute of Arbitrators.

Thara GOPALAN
Vice President, International Centre for Dispute Resolution
Thara is Vice President at the International Centre for Dispute Resolution (ICDR), the international division of the American Arbitration Association, a not-for-profit and the world’s largest provider of ADR services. She thrives at the intersection of law, strategy, and dispute resolution, combining legal insight with institutional leadership to expand access to fair, neutral processes worldwide. Thara leads the ICDR’s strategic development and operations across Asia, Africa, the Middle East, and Oceania, overseeing staff and services in the region, including the AAA-ICDR Asia Case Management Centre in Singapore. A commercial disputes lawyer by background, she is admitted as an Advocate and Solicitor of the Supreme Court of Singapore. Thara has acted in complex, high-value disputes before all levels of the Singapore courts and in international arbitrations and mediations under major institutional rules. She holds an LLB (Hons) from the University of Bristol and an LLM from University College London.
